DashGo Delivery 1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website and services operated by DashGo Delivery ("DashGo," "we," "us," or "our"). By placing an order or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Description of Services
DashGo Delivery offers e-commerce delivery, food and grocery delivery through our marketplace, errand and parcel delivery, payment-on-delivery collection, and local business delivery, currently serving Calabar and Enugu, Nigeria. Specific service levels, pricing, and packages are set out on our website and may be updated from time to time.
3. Eligibility & Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use our services or enter into a contract with us. If you use our services on behalf of a business, you represent that you have the authority to bind that business to these Terms. You are responsible for the accuracy of the information you provide.
4. Ordering & Payment Terms
For payment-on-delivery ("COD") orders, payment is collected by our courier at the point of delivery on behalf of the merchant, and remitted to the merchant in accordance with the applicable service plan. For business clients, invoicing terms, delivery volumes, and payment schedules are agreed in a separate service agreement or order confirmation. Prices for Standard, Premium, and Business delivery plans are as published on our website or as quoted directly, and may change with reasonable notice.
5. Marketplace Terms (Food & Groceries)
Restaurants and eateries may list their meals on our marketplace at no listing cost. By listing, a vendor confirms that the information provided about their meals, pricing, and availability is accurate, and agrees to fulfil orders placed through the marketplace within the timeframe shown to customers. DashGo Delivery handles the pickup and delivery of marketplace orders but is not responsible for the quality, preparation, or accuracy of food items, which remains the responsibility of the listing restaurant or eatery.
6. Delivery Service Terms
DashGo Delivery provides errand, parcel, food, and local business delivery services within its published service areas. By booking a delivery, you agree that:
- You will provide accurate pickup and delivery information, including addresses and recipient contact details.
- You will not request delivery of illegal, hazardous, or prohibited items.
- Delivery windows and confirmation times are estimates and may vary due to traffic, weather, or circumstances beyond our reasonable control.
- Liability for lost or damaged items is limited as set out in the applicable service plan or order confirmation, unless caused by our gross negligence or willful misconduct.
7. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of DashGo Delivery or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
8. Acceptable Use
You agree not to use our services to violate any law, infringe on the rights of others, transmit harmful code, or interfere with the operation of our website or services. We reserve the right to suspend or terminate access for any use that violates these Terms.
9. Third-Party Links & Services
Our services may reference or link to third-party websites, payment processors, or platforms (such as WhatsApp for booking, or our own marketplace at crm.dashgodelivery.com). We are not responsible for the content, policies, or practices of third parties, and your use of third-party services is subject to their own terms.
10. Disclaimers & Limitation of Liability
Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, DashGo Delivery disclaims all warranties, express or implied, and shall not be liable for indirect, incidental, or consequential damages arising from your use of our services. Our aggregate liability for any claim arising under these Terms shall not exceed the amount paid by you for the specific service giving rise to the claim.
11. Indemnification
You agree to indemnify and hold DashGo Delivery and its officers and employees harmless from any claims, damages, or expenses arising from your breach of these Terms or your misuse of our services.
12. Termination
We may suspend or terminate your access to our services at any time for conduct that we believe violates these Terms or is otherwise harmful to other users, our business, or third parties. You may stop using our services at any time.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Any dispute arising from these Terms shall first be addressed through good-faith negotiation and, if unresolved, submitted to the exclusive jurisdiction of the competent courts of Nigeria, unless otherwise required by applicable consumer protection law.
14. GDPR & International Users
